Why Arizona’s Community Property Laws Make a Prenup Worth Considering

Arizona is a community property state under A.R.S. § 25-211. Most assets and debts acquired during a marriage are owned equally by both spouses, regardless of who earned the income or whose name is on the account. If a marriage ends without a prenuptial agreement in place, those default rules govern how property is divided.

A prenuptial agreement, formally called a premarital agreement under Arizona law, lets prospective spouses set their own terms rather than accepting the state’s defaults. Under A.R.S. § 25-202, the agreement must be in writing and signed by both parties. It becomes effective on the date of the marriage and doesn’t require additional consideration to be enforceable. Arizona follows the Arizona Uniform Premarital Agreement Act, A.R.S. §§ 25-201 through 25-205, which governs how these agreements are created, enforced, and amended.

Under A.R.S. § 25-403, those decisions are made at the time of divorce based on the best interests of the child, and no prenuptial agreement can override that standard. A court may also decline to enforce a prenuptial agreement if one party didn’t execute it voluntarily, or if it was unconscionable at the time of signing and the challenging party wasn’t given fair and reasonable financial disclosure.
